Files with PELRB to decertify from Teamsters

March 28, 2007 – The Seabrook Nuclear Power Plant is clearly a dominate figure as it rises along the costal harbor and it reminds us all of the power it possess. Yet, immediately after the terrorist attacks of September 11th - it was also a fearful reminder of the potential risk for a terrorist attack. However, to the many members of the Seabrook, NH Police Department it wasn’t just another national target which needed to be protected as they guarded the gates of this nuclear fortress against enemy attacks and terrorist threats – it was home. However, some of the citizenry has apparently forgotten those brave and dedicated members of the Seabrook, NH Police Union as they recently KO’d the police contract and approved the firefighter’s contract at recent town meeting – after both contracts were approved by the Board of Selectman and the Finance Committee.

Those same dedicated police officers who put their own lives at risk, as well as the safety and security of their own families are now being denied a fair and decent contract. The membership has turned to the fastest-growing all-exclusive law enforcement labor organization in New England to help turn the tide and get them the same contractual protection their brothers and sisters in public safety currently enjoy. The Seabrook, NH Police Union by a devastating 21-1 majority vote elected to disaffiliate from the International Brotherhood of Teamsters and join the New England PBA, I.U.P.A., AFL-CIO.

Seabrook, NH Police Union President Scott Mendes said, “We believe the New England PBA has a proven record of accomplishment and we are looking forward to being represented by experienced and knowledgeable law enforcement professionals.”

New England Regional Vice President Ron Scaccia called the addition of the Seabrook Police Union, “A monumental step for the New England PBA in our growth in New Hampshire and a giant step for those members who need and deserve better representation.”

Holway Caves Under Pressure

March 22, 2007 – The presidential season is upon us and the proverbial FLIP-FLOP of positions has officially begun or perhaps “Capt Chaos” Holway has finally awoken from his self-induced coma. Whatever the case, the clown prince of labor spoke in opposition of his own legislation, which was doomed for failure from the start. The legislation he proposed was to eliminate the current regional and city retirement boards, thus allowing the state system to take over these boards. But, a funny thing happened on the way to the Statehouse as Holway decided to “change his position”.

As we DEMANDED in an earlier article and as other labor unions agreed, Holway’s ill-advised plan simply made no financial sense. In fact, most regional and city retirement systems far out perform the state system in terms of their rate of return for its members. Yet, as the Joint Committee on Public Service listened to the testimony of “Captain Chaos” and watched his two-step flip-flop, others were amazed at his attempted stab at humor which fell upon deaf ears, especially to the other labor leaders in the hearing room. His reference to his idol “John Kerry” was marred by the fact that although he and Senator Kerry have similar political ultra-liberal characteristics – “You sir are no John Kerry!”

Surprisingly, the man who made a living as the former lobbyist for the Middlesex Retirement Board, which lost over 50 Million Dollars under the leadership of his good friend and Executive Director Jim Fahey, now wanted to file legislation to abolish the board. Yes, the same Jim Fahey who just recently left the employ of the Middlesex Retirement System and who has two daughter’s working at NAGE, one of whom is a member of the State Retirement Board. If you are starting to think things look a little shady…Rest assured we will continue to monitor the legislative process and work to defeat any more foolhardy legislation proposed by those who have their own personal agenda.

FEDERAL GOVERNMENT REFUSES TO
PAY LINE OF DUTY DEATH BENEFITS

Hometown Heroes Act of 2003 – DENIED

March 21, 2007 – The Hometown Heroes Act of 2003 was passed by the Congress of the United States and signed into law by President George W. Bush, but the Department of Justice has denied 34 claims by families of those killed in the line of duty. The Justice Department has also refused to act upon 206 other cases, which are currently pending. A spokeswoman for the Department of Justice said the delays are cased by the complexity of the cases, not by any disagreement with the law.

The law provides for those who die as a result of heart attacks and strokes to be presumed to be line-of-duty deaths, thus making their survivors eligible for federal death benefits. Yet, the Department of Justice has denied payment of these claims to the families of 11 law enforcement officers who have filed for the line of duty death benefit under the Hometown Heroes Act of 2003.

A study to be published in the New England Journal of Medicine on Thursday by researchers from the Harvard School of Public Health brought these denials to light. However, the New England PBA, I.U.P.A. Local 9000, AFL-CIO has contacted our national affiliate, the International Union of Police Associations, AFL-CIO with respect to this issue and I.U.P.A. National President Sam A. Cabral has assured us of his support in rectifying this travesty of justice.


Public Safety Officers' Benefits (PSOB) Program: Hometown Heroes Survivors Benefits Act of 2003
Enacted in 1976, the Public Safety Officers' Benefits (PSOB) Program is a partnership effort of the U.S. Department of Justice; local, state, and federal public safety agencies; and national organizations to provide benefits to the spouses, children, and other survivors of public safety officers who have died from a traumatic injury or who have been totally and permanently disabled in the line of duty.
On December 15, 2003, the Hometown Heroes Survivors Benefits Act expanded the circumstances under which public safety officer deaths resulting from heart attacks and strokes may be covered by the program.

  • The Hometown Heroes Act establishes a statutory presumption that public safety officers who die from a heart attack or stroke following a non-routine stressful or strenuous physical public safety activity or training, died in the line of duty for benefit purposes.
  • The Hometown Heroes presumption may be overcome by "competent medical evidence to the contrary."
  • The Hometown Heroes Act excludes actions of a "clerical, administrative, or nonmanual nature" from consideration.
  • The regulations governing the Hometown Heroes Survivors Benefits Act, as well as the entire PSOB Program, were finalized September 11, 2006.
  • In the meantime, the PSOB Office continues to work closely with OGC to assess the information provided thus far on Hometown Heroes claims.

AS PROBLEMS MOUNT FOR IBPO/IBCO

March 17, 2007 – As the Massachusetts Labor Relations Commission continues with dozens of hearing and elections for law enforcement locals looking to leave the IBPO and IBCO, more bad news on the doorstep for the former law enforcement union powerhouse.

Another cop turned union representative has pulled the proverbial plug on the IBPO in the state of Connecticut. National IBPO Representative Jim Horan is the latest crew member to jump ship as the S.S. NAGE plunges to the bottom of the sea. Sgt. Horan was the former union president in Newington, Connecticut and was a long-time employee and one hell of a good labor representative. We wish Jim well and look forward to speaking with him soon.

In fact, New England PBA Executive Director Jerry Flynn has stated he will contact “Gentleman Jim” and see if he is interested in joining the fastest growing all-exclusive law enforcement organization, the New England PBA, IUPA Local 9000, AFL-CIO. Flynn said, “We are shocked, but not surprised they would lose someone with the caliber and commitment of Jim Horan.” Flynn added, “Jim Horan is a respected and knowledgeable union leader and it is another prime example of the fish rotting from the head down!”

But, that is not the only bit of bad news for our little green friend at 159 Burgin Parkway. Apparently, the IBPO has decided NOT to have its annual police week social gathering as the Holiday Inn at Capitol Hill. According to the grapevine, “Captain Chaos” Holway said it was TOO EXPENSIVE…. This from the guy who once said the candlelight vigil ceremony at the National Law Enforcement Memorial was “TOO LONG!” WHAT A DISGRACE!!!

Sources say, the event was a flop last year and since Flynn left the IBPO and no longer runs the event it had lost its luster and political savvy for which it was once so famous. The event in past years included such political titans as Senator Joe Biden, Sen. John Kerry and Senator Max Cleland, as well as many other members of Congress.

Of course, those IBPO/IBCO law enforcement officers who make the annual pilgrimage to National Police Week in Washington, D.C. may not be TOO HAPPY…but Holway has his priorities straight. According to the NAGE, Federal Labor Filings LM-2’s they still have their RED SOX Season Tickets. TOO EXPENSIVE – NOT TOO EXPENSIVE TO SEE DICE-K AND 9 INNINGS ISN’T TOO LONG, IS IT?

SET TO DECERT FROM IBCO

TRUSTEE A NO-SHOW AT LRC HEARING

March 14, 2007 – The Massachusetts Department of Corrections – Captain’s, the highest ranking unionized correctional officers in the Commonwealth of Massachusetts, finally had their day before the Massachusetts Labor Relations Commission. The union filed a decertification petition with almost 100% “show of interest cards” from their membership in order to leave the sinking ship known as NAGE/IBCO. However, before the ink was dry on the petition, the Supreme Allied Commander of NAGE placed the local in trusteeship, removed their elected leadership and took over their bank accounts and treasury. He then placed his loyal rump swab and admitted criminal misfit as trustee over the local’s affairs. The same trustee who left weeping after serving one day of hard union labor as the trustee at the Middlesex Sheriff’s Department in Billerica, MA. In fact, nobody has seen her since and she was a NO-SHOW today – persistent rumors have been circulating for weeks that she is in the Federal Witness Protection Program.

Today, the Massachusetts Labor Relations Commission held a pre-hearing to determine the make-up of the unit and to ensure the process will ultimately lead to a fair and impartial election. The hearing officer asked pointed and thorough questions of all parties, including the elected President William Ryan and elected Vice President Shaun Dewey with all parties agreeing to a consent election. The DOC attorney also agreed to provide additional documentation to the commission and the hearing date will remain as originally stated, but the end is in sight.

The IBCO is now waging the “battle of the dues” with their members, although this battle has only begun they have increased IBCO Captain’s dues from $7.00 per week to a whopping $11.65 per week, the IBCO also has refused to return over $30,000.00 in overage checks that belong to the local. But, they have to increase dues to make up for the over 2,000 law enforcement officers who have left or have petitioned to leave over the past eighteen (18) months. The New England PBA, Inc. I.U.P.A. Local 9000, AFL-CIO has offered their legal staff of attorney’s to work with the Captain’s to ensure their monies are retuned to those who work so hard to earn it!

Hopefully, for those Captain’s who have been treated more like common criminals than professional law enforcement officer’s – this nightmare of being represented by the International Brotherhood of Correctional officers will finally be over. But, as several of them said - not soon enough!

TWO IBPO DECERTIFCATIONS PETITIONS HEARD
New Hampshire PELRB Sets Election Dates

March 13, 2007 – The Public Employees Labor Relations Board in the State of New Hampshire held hearings in the Granite State over the last two days to determine the election dates for two separate locals. The Nashua, NH Police Dispatcher’s Union filed decertification petitions to join the New England PBA, Inc., I.U.P.A. Local 9000, AFL-CIO. The first hearing was held at the Nashua, NH Police Department under the guidance of PELRB Executive Director Donald E. Mitchell, Esq. The Nashua Dispatcher’s Union has followed the lead of the Nashua Police Supervisor’s Association by filing a decertification petition to leave the IBPO.

New England PBA Executive Vice President Martin Conway attended the hearing, along with the local union president Michelle Tremblay. The IBPO also sent a representative who attended the meeting, but IBPO National Director Paul Birks was noticeably missing. Sources close to the local claim the last time he was in Nashua, NH would have been his first! Perhaps, we will get a glimpse of the illusive National Director at the election, which is scheduled for April 4, 2007.

Where is Paul?

A hearing was also held today for the Epping, NH Police Union who filed a decertification petition to leave the IBPO and join the New England PBA, Inc., I.U.P.A. Local 9000, AFL-CIO. The hearing was held at the Epping, NH Police Department by PELRB Executive Director Donald E. Michell, Esq. and the town was represented by the Chief of Police. Representing the New England PBA was Executive Director Jerry Flynn and Director of Organizing Russ Taylor. The IBPO was represented by Representative Garrett Mahoney, but again no sign of Paul Birks. The representation election for the Epping Police Union is scheduled for April 3, 2007.

Finally, if anyone has any information as to the whereabouts of the National Director of the IBPO, Paul Birks please notify info@nepba.org because we have hundreds of members who would like to meet him or at least say good bye before they leave the IBPO.

Vast Changes to NHRS Called “Knee Jerk Reaction”


New England PBA Legislative Director Paul Larkham testifying before NH Senate

March 8, 2007 – The New England Police Benevolent Association, IUPA, AFL-CIO continued to fight for the hard working men and women of law enforcement in the Granite State as Legislative Director Paul Larkham testified against changes to the New Hampshire Retirement System. In fact, the main sponsor of one of these retirement bills was too busy vacationing in Hawaii, than making himself available to testify. State Representative Ken Hawkins of Bedford was working on his tan as the New England PBA was working to have his legislation rejected.

New England PBA Legislative Director Paul Larkham spoke about the huge cost of training police officers should the New Hampshire Retirement System be altered, which would force many senior officers from both the police and fire to retire prematurely. He also spoke of the fact that NH Law Enforcement Officers are paid approximately $9,000 less than the national average ($37,000-NH/$46, 000-Nat. Average). Director Larkham also spoke about the diminished salary of those officers, if the exclusion of details were adopted as proposed by the vacationing representative.

The New England PBA has received numerous compliments regarding Paul’s very articulate and factual testimony. But, the battle is far from over and we need to keep the pressure on those who want to take away what we have earned. We are just happy Paul Larham wasn’t in Hawaii working on his tan – like the absent minded representative.

SENATE COMMITTEE APPROVES “MICHAEL’S LAW”

New England PBA Sponsored Bill Moves thru NH Senate

March 7, 2007 – The New England PBA sponsored bill commonly called “Michael’s Law” passed the first hurdle in the NH State Legislature, as both New England PBA Executive Director Jerry Flynn and Legislative Director Paul Larkham testified before the Senate Committee. The Executive Departments and Administration Committee voted unanimously on the bill, which will provide a $100,000 death benefit for police and firefighters killed in the line of duty. It also recommended amending the bill to include EMS workers in the Senate Bill 169, known as Michael’s Law.

The bill is named for Manchester Police Officer Michael Briggs, who was killed while responding to a report of domestic violence in October 2006. The chief sponsor of the bill, Sen. Lou D’Allesandro (D-Manchester) said, “We have a moral responsibility to take this to the legislature and to pass it. It is the least we can do for a police officer or firefighter who has done so much for us.”

New England PBA Executive Director Jerry Flynn applauded the efforts of Senator D’Allesando and called Officer Michael Briggs “A true American Hero.”

Sarah and Melisa Briggs of Epsom, sisters of Officer Michael Briggs were also present at the hearing and Melisa said, “It’s just a great thing they are doing. Police and firefighters put their lives on the line every day. We know Michael would be truly honored by this effort.”

March 5, 2007 – The Massachusetts Labor Relations Commission has scheduled all the pre-hearing and hearing dates for the dozens of locals looking to leave the IBPO & IBCO. However, the IBPO continues to send propaganda and outright lies to those locals who are just waiting to have an election so they can leave. In fact, the most recent threat was they would discontinue the dental and vision benefits of the Supervisor's at the Middlesex Sheriffs – if the Middlesex Sheriff's pull out of the IBCO. They are obviously hoping that the Supervisors' will pressure the younger officers into staying so they won't lose their benefits. What a disgrace…for any union to blackmail its own membership!

The GOOD NEWS is the ballots will be sent out in the next few weeks and the ballots will be counted at the Massachusetts Labor Relations Commission on April 18 th . Furthermore, the New England PBA, I.U.P.A. Local 9000, AFL-CIO would be more than happy to sit down with the leadership of the Middlesex Sheriff's Supervisor's Association and provide them with our far superior Dental & Vision Trust Benefit. Unlike, those who are dangling a carrot in front of your nose – we will do it because it is the right thing to do!

NAGE/IBPO Should Withdraw Legislation

February 28, 2007– Once again the clown prince of financial ruin as decided he hasn’t run his own ship into the ground fast enough – so he now wants to abolish local and regional retirement boards. NAGE/IBPO David J. Holway has filed legislation entitled, NAGE’s Massachusetts Pension Reform “An Act Relative to Funding Local and Regional Retirement Boards” which would essentially eliminate local control of local and regional retirement boards and would mandate all systems into the PRIM after five (5) years.

In an obvious attempt to garner support for his ridiculous legislation, both he and his alleged lobbyist met with several state and local union leaders, including the Boston Police Patrolman’s Association, I.U.P.A. AFL-CIO. His attempt to gain support with other state unions have fallen on deaf ears, in fact Robert McCarthy, President of the Professional Fire Fighters of Massachusetts sent a letter to Captain Chaos calling the measure “fiscally imprudent” and requested he withdraw the proposed legislation. OPEIU Local 6, AFL-CIO President Mary Mahoney was also less than impressed with the idea calling the legislation “ill advised”.

The New England PBA, I.U.P.A., AFL-CIO is adamantly opposed to this legislation and will speak in opposition of the proposed legislation at a public hearing at the State House on March 22, 2007. We are hopeful that this legislation will NOT see the light of day or as New England PBA President Bryan W. McMahon stated, “Who in their right mind would file this bill?” ENOUGH SAID!

February 16, 2007 – Instead of addressing the failures of his once promising reign as King of Organized Labor, the enraged tyrant of Burgin Parkway has once again shown his true colors. He continues to place locals in trusteeship because they simply have filed decertification petitions to leave the sinking ship known throughout the region as the S.S. NAGE. Like most tyrants, he has a multitude of titles including, National President of NAGE, IBPO, IBCO, IAEP and so on and so on….but, apparently his most powerful position is that of Supreme Trustee of Corrections.

On September 11, 2006, the Middlesex Sheriffs filed a decertification petition with the Massachusetts Labor Relations Commission in order to choose between their current exclusive representative and the New England PBA, Inc., I.U.P.A., AFL-CIO. However, before most of the local had even realized that the S.S. NAGE had hit an iceberg and was sinking faster than the Titanic, “Captain Chaos” Holway pulled up the row boats and tossed the Middlesex Sheriff’s Executive Board overboard.

But, that wasn’t enough – he also tried to have their president walk the plank by attempting to file FALSE criminal charges against him, which were ultimately rejected by the Nashua, NH Police Dept.

Now, “Captain Chaos” has repeated his arrogant ways by also placing the Massachusetts DOC Captain’s in trusteeship – ONE DAY AFTER they too have filed a petition with the Labor Relations Commission to join the New England PBA, Inc., I.U.P.A. Local 9000, AFL-CIO. But, the similarities don’t end there “Captain Chaos” also took over their treasury and drummed up more false charges against some of the most respected members of the DOC Captain’s, including President William Ryan and Vice President Shawn Dewey. NAGE also refuse to return over $30,000 in overage monies due the DOC Captain’s.

Apparently, “Captain Chaos” has forgotten the last history lesson which the Newton Police gave NAGE several years ago. NAGE lost that case too! The New England PBA has offered their legal services to the DOC Captain’s in order to remove the trusteeship and to return the $30,000 in overage dues to its rightful owners, but maybe NAGE just need the money to make payroll this week. Whatever the case we will keep you updated, because as Ken Lyons said, “We Tell It Like It Is – Isn’t that the Best Way!

NAGE WANTS MIDDLESEX SHERIFF’S
TO PLAY DEAL OR NO DEAL


February 14, 2007 – Apparently after watching the comical Howie Mandel wheel and deal his way to stardom on the popular TV show “Deal or No Deal” our own “Captain Chaos” Holway of the sinking S.S. NAGE has decided to play riverboat gambler again! His recent mailing to the Middlesex Sheriff’s not only takes credit for every piece of legislation since the Emancipation Proclamation, he also decides to cut a deal to lower their dues – IF they stay with NAGE. “Captain Chaos” says he won’t raise your dues – DEAL or NO DEAL?

He wants the Middlesex Sheriff’s to believe they should TRUST him – RIGHT!

• TRUST the guy who removed your ELECTED Executive Board.
• TRUST the guy who broke-into your union office and took your local funds.
• TRUST the guy who shoved a contract down your throat because he could.
• TRUST the guy who tried to get criminal charges against one of your members.
• TRUST the guy who NEVER was a correction officer – HE WAS MANAGEMENT!
• TRUST the guy who refuses to return OVER $30,000 in dues money to the DOC Captain and placed them in trusteeship ONE Day after filing a decertification petition.

NAGE even took credit for the 20/50 Retirement Bill, which is another outright LIE! The legislation was pushed through the Massachusetts Legislature by AFSCME Council 93, AFL-CIO and three correction officers from MCI Concord named Al Deschluer, Andy Rourke and the late Lenny Scott. New England PBA Executive Director Jerry Flynn was a 23 year old Correction Officer and a member of that negotiation team and he was in Governor Dukakis’s Office when the legislation was signed into law. The current NAGE lobbyist was where he has been for the last 20 years – NOWHERE TO BE FOUND!

The amazing thing is the National Executive Board of NAGE already VOTED to increase the current dues $2.00 for all their members, not to mention a slew of other hidden increases. In fact, under the “NEW” rules adopted by the NAGE “Bobbing Head Society” requires every local to turn over their books twice a year to the guy who will determine if you have enough money. NOW “Captain Chaos” is hoping the Middlesex Sheriff’s will play Deal or No Deal?

How Long Before SEIU Puts Them In Trusteeship – AGAIN!

February 8, 2007 – The National President of the National Association of Government Employees, (NAGE) SEIU, President of the International Brotherhood of Police Officer (IBPO), President of the International Brotherhood of Correctional Officers, President of the International Association of EMT’s & Paramedics and the Supreme Allied Commander of whatever federal groups he represents, has yet another name to add to his menagerie of titles.

DAVID J. HOLWAY as President of NAGE has lost more locals to decertification than any other National Labor Organization in the United States, according to the National Labor Relations Commission the average number of decertification petitions filed against any labor organization is generally between 6-12 locals per year. The Massachusetts Labor Relations has never had more decertification petitions filed against any one single labor organization than those that have been filed against NAGE/IBPO/IBCO in the last two years. The New Hampshire Public Employees Labor Relations Board also has never had as many decertification petitions filed regarding IBPO/SEIU.

NAGE President David “Captain Chaos” Holway has only been at the helm of the sinking ship S.S. NAGE since 2002 – But let’s look at some of his lofty accomplishments:

• In 2002, NAGE had over $13 Million Dollars in ASSETS – TODAY they owe more than in legal judgments than they have in the bank. Capt. Chaos claims the “Lowell Bus Case” is the root of his financial problems – the Truth is NAGE has never paid a single dime of the $2.2 Million Dollar judgment to Ms. Dixon or to a female employee who is also owed in excess of a million dollars between the civil judgment and legal fees.

• NAGE could have settled both these cases for pennies on the dollar – BUT, like the riverboat gambler he is, “Captain Chaos” rolled the dice and mortgaged our future.

• In 2002, NAGE had no mortgage on the National Headquarters at 159 Burgin Parkway, Quincy, MA – TODAY that property reportedly has more mortgages owed on it than a poorly played monopoly game; and sources say NAGE can’t wring out any more liquid cash out of the former cash cow and are looking at selling the former national treasure.

• In 2003, NAGE Housing, Inc. sold out to Edward Fish & Associates a development project they partnered with in Lowell, MA for minuscule 2 Million Dollars – TODAY that project is worth more than $50 Million Dollars.

• Since 2002, OVER 3,000 members have decertified from NAGE/IBPO/IBCO/IAEP

REFUSES TO MEET WITH NEPBA

NAGE President David J. Holway and his Chief of Staff Bernard Flynn were missing in action

February 9, 2007 – At 3:25 pm, on Friday afternoon the NAGE parking lot was as empty as the promises made by its president and his cute cliché “Members First”. Our union president was nowhere to be found and the executive vice president, Jim Farley refused to meet with two of the founding members of the New England Police Benevolent Association, AFL-CIO.

New England PBA President Bryan W. McMahon and Executive Director Jerry Flynn went to the NAGE National Headquarters in Quincy, MA to personally speak with National President David J. Holway about all those questions he had regarding his inability to contact the New England PBA, Inc., I.U.P.A. Local 9000, AFL-CIO by telephone. His latest claim is as ridiculous as his $257,667 salary, which is as Boston Globe reporter Steve Bailey pointed out - $8,000 more than his boss Andy Stern, President of SEIU.

But, apparently 3:25 pm on a Friday afternoon was a little too close to Tea Time at Guido’s Florida Café for Captain Chaos. So they tried to speak with Executive Vice President Jim “Seven Second Delay” Farley, who surprisingly answered his phone and said “Hello” before the two minute warning. However, he apparently got a little tongue tied and refused to meet with them as they waited patiently in the vacant parking lot. The recycled Director of the IBPO/IBCO in Massachusetts David Bernard was also out of the office and apparently out of state working on his golf game because his phone message stated he was out of the office until Monday, February 12th.

All they wanted to know was why the President of NAGE refuses to tell the truth to the IBCO members by claiming the New England PBA didn’t respond to his alleged phone calls. Like, our members we respond and we don’t hide behind a desk, a bar stool or miss days because we are on the links – WE GO TO THE SOURCE. Our members don’t to have to come to us – WE GO TO THEM, but our old friends at NAGE still can’t quite figure that SERVICE is the name of the GAME!

Sean McArdle Promoted to Regional Director

February 9, 2007 - The New England PBA, I.U.P.A. Local 9000, AFL-CIO has finalized an agreement with the prestigious Law Firm of Hanley, Hassett and Fitzsimmons, LLC of Quincy, MA. As part of the agreement, the New England PBA will be relocating their South Shore operations to the Quincy Office, which will be managed by New England PBA Regional Director Sean McArdle.The office is located at 40 Willard Street in Quincy, MA

New England PBA President Bryan W. McMahon announced the agreement and the promotion of Sean McArdle as Regional Director of the South Shore at the monthly meeting of the Dental & Vision Trust in Quincy, MA. President McMahon stated, “We are continuing with our mission of controlled growth, but as we grow we will continue to add services and benefits for our members.”

New England PBA Executive Director Jerry Flynn stated, “Sean McArdle is a tremendous talent and a dedicated professional labor leader who will do a great job!” He further stated, “We are showing our members on the South Shore that our actions speak louder than our competitor’s false claims and empty promises; we are growing and they are going!”

New England Regional Vice President Dwayne Goldman called the agreement, “A monumental step in providing services and benefits to those of us on the South Shore.” He also stated, “Sean McArdle is the consummate professional and an exceptional talent with respect to labor relations."

New England Executive Vice President Marty Conway called the addition of Hanley, Hassett and Fitzsimmons, LLC, “This is an extension of our professional services and a welcomed addition to the tremendous legal services we currently provide with Nolan | Perroni, LLP of Lowell.”

IBPO Loses the Doubleheader

Feb. 6, 2007 – As the Chelmsford Police Supervisor’s Union voted unanimously to join the New England Police Benevolent Association, Inc, I.U.P.A. Local 9000, AFL-CIO, their brother and sister police officers in the Chelmsford Police Patrolman’s Union also voted overwhelmingly to leave the International Brotherhood of Police Officer (IBPO). As a strong sign of their lack of support, the former union powerhouse received just one (1) single vote between both of these local police unions. The day-light doubleheader held at the Massachusetts Labor Relations Commission was over before it began and the baseball analogy was clearly evident as the IBPO was swept - like the Yankees in the final four games of the ALCS in 2004.

As the recycled Director of the IBPO in Massachusetts, David Bernard suffered his second loss in relief for former ace Paul Birks who has been delegated for assignment and possible has seen his last start. As the International Brotherhood of Police Officers (IBPO) attempt to re-shuffle the same old bag of broken bats, the New England PBA looks stronger than the starting pitching for the 2007 Boston Red Sox. In fact, we predict DICE –K will have less wins than New England PBA Regional Director Sean McArdle will have at the Labor Relations Commission in 2007.

In 2004, the Boston Red Sox World Series Champions had many heroes including Curt Shilling, Johnny Damon and Big Pappy, but only one MVP in the person of Manny Ramirez. The Chelmsford Police Patrolman’s Union also had many heroes, including current Local President Brian Mullen, who attended meetings on both the decertification process and conferences with I.U.P.A. to ensure their members were making an informed and educated decision.

But, the MVP of the Chelmsford Police Patrolman’s Union during this entire process was its long-time President Frank Goode who was perhaps the most vocal critic of the IBPO for most of his tenure. He stood up and made sure those he represented received the legal services and the representational services they deserved. He was by all accounts the leader who put his own career in limbo to ensure that those he represented received the benefits they deserved. In fact, as the highest scorer in the last Sergeants exam he was by-passed by the previous town manager for a promotion he most certainly deserved. We believe by-passing an effective leader as Officer Goode is simply retaliation for his vigorous representation and because of his vocal opposition of the former town manager. Those of us at the New England PBA will always be indebted to former President Goode and we are hopeful that the new administration will correct the injustice that was handed out by the previous administration and promote Officer Francis Goode, Jr. to the rank of Sergeant – because he has paid the price and his family deserves better.

We would like to thank all the members of the Chelmsford Police Patrolman’s Union and the Chelmsford Police Supervisor’s Association for their patience and their support during this lengthy process, particularly Local Union Presidents Sergeant Todd Ahern and Detective Brian Mullen.

Another IBPO Local FINALLY Gone

Feb. 6, 2007 – The Chelmsford Police Superior Officer’s Union pitch a gem and when the dust settled it was NO Runs, NO hits, ALL Errors for the International Brotherhood of Police Officers (IBPO). After nearly a year of legal wrangling and frivolous challenges by the former union powerhouse, the Chelmsford Police Superior Officer’s Union hit for the cycle and shut-out the IBPO and joined the fastest growing, all-exclusive law enforcement organization in the region, the New England PBA, Inc., I.U.P.A. Local 9000, AFL-CIO.

It was yet another setback in the re-hab start for the former Ace and the re-cycled Director of the IBPO in Massachusetts, David Bernard. His hollow comments of returning the IBPO to its thrilling days of yesteryear have obviously fallen on deaf ears and his lack of law enforcement experience is self-evident by the comments of the local union leadership.

Chelmsford Superior Officer’s Union President Todd Ahern stated, “We are ecstatic to finally be represented by a REAL law enforcement union who represents ONLY law enforcement officers and getting away from those who represent janitors and security guards.” He further stated, “The fact that IBPO has NO police officers at the helm speaks volumes for what they think about police locals. Thankfully, we NO longer have to worry about them.”

Chelmsford resident and New England PBA Executive Director Jerry Flynn called, “This is personally a proud a moment because those who protect me and my family had enough confidence in us to represent their interests; we are extremely pleased to be representing the Chelmsford, MA Police Superior Officers’ Union.”

Secretary-Treasurer Andrew Ray stated, “We have already hit the ground running and are sitting down with the leadership to begin contract negotiations today!”

Chrysler plans to cut 10,000 jobs

Can NAGE/IBPO/IBCO be far behind?

Feb 5, 2006 – As one of the big three auto makers announce layoffs of 10,000 jobs because of downsizing their production, we can only wonder how much longer the sinking ship known as the S.S. NAGE can stay afloat. With Captain Chaos (a.k.a. David Holway) still at the helm and shuffling personnel like a card dealer in Las Vegas, he continues to lie to his shrinking membership which is dwindling faster than the bald spot on his squash.

Unfortunately, it appears some of the crew has decided to go down with the ship as well. Just last week, the so-called union representing the staff decided to disband and go it alone with promises of a raise. Imagine a union that supposedly represents union members, isn’t even organized themselves and its leader didn’t demand that its own members be organized. What do you expect from Captain Chaos – except more empty promises? Similar to the band that continued to play on the deck of the Titanic, Captain “Chaos” continues to perpetuate some of the best storytelling and fables since Walt Disney himself. He continues to blame everyone else for his obvious failure, except the person in the mirror. His personal attacks are the moronic work of the desperate drowning victim he will soon be.

Luckily, almost 2,000 members have grabbed their life jackets and jumped off the sinking vessel and are now being rescued by the New England PBA, Inc., I.U.P.A. Local 9000, AFL-CIO. We have filed over 22 petitions with the Massachusetts Labor Relations Commission and we are awaiting action on several elections in the next few days. We will keep you posted on our progress and if you are still floating along and want to be rescued give us a call or send up a flare we will find you!
